Some folks are spending far more energy on this matter than is practical.
Fact: Only the President may sign a Treaty (At this moment the skuttlebutt is that Hillary will sign as a political signal)
Fact: The Senate must approve by 2/3 majority - and they do not have 67 votes for this treaty.
Fact: Even if the President signed and the Senate ratified, it is null and void because no treaty may trump fundamental Constitutional Rights.
This treaty has no more Constitutional validity than any other law passed in America that infringes 2A.
They only have the Power and Authority you permit them.
They may imprison or kill you for your disobedience, but they'll never have moral right on their side.
Of course, if Americans respect the law even if it is unconstitutional, then it doesn't much matter. Until Americans refuse to respect unconstitutional laws, the chains will grow tighter.

Hey, we agree about something! I've been saying this is a non-issue for quite a while. Even without all the legal details, as if they meant anything anyway, I don't see a whole lot of people of any political persuasion saying, "Yes sir, here they are and don't forget all that ammo."

The UN can't even stop genocide; they write stern letters. They are the same sad joke as the League of Nations, only there are a hundred Ethiopias. They will fail to prevent a world war just like the League did, and with as much stuttering excuse mongering and finger pointing.

Article 2, Section 2: "He shall have Power, by and with the Advice and Consent of the Senate, to make Treaties, provided two thirds of the Senators present concur..."
ReplyDeleteIt won't take 67 senators....let's say, for example, that 21 D senators stayed on after recess, and POTUS decided to sign it, it would only take 14 to ratify it, satisfying the constitutional language.
Even if it were executed as such, a treaty that abrogates the Constitution or any of the limitations on government, even if signed and 'ratified' by 2/3's of those senators present, cannot have the force of law, because the treaty itself is repugnant to the Constitution. Ergo, there is no duty to comply.
Stretch that out a bit further: Even if the federal government stated the opposite, which it most likely would, non-compliance should be considered a sacred duty by the citizenry, as compliance would be akin to a rapist telling a victim to lay down her knife and he wouldn't rape her...and the woman complying.
Just sayin'

The problem is, the treaty will give them the excuse to go ahead and start taxing and regulating firearms and ammo out of the reach of most people.
